Hereinafter referred to as "the Seller" or "ADSValley".

2. Purpose

These Terms of Sale define the rights and obligations of the parties in the context of the online sale of subscription services offered through the Case Watch application and website. Any subscription implies unconditional acceptance of these Terms of Sale.

3. Services Offered

Case Watch is a subscription-based service for tracking court cases in Tunisia and providing notifications relating to the procedural status of case files, based on public information issued by Tunisian courts. The offers (plans/subscriptions) displayed on the site or application at the time of consultation constitute the applicable commercial reference. Service descriptions are provided for information purposes only.

4. Service Availability

Offers and prices are valid for as long as they are visible on the site or application. The digital service is provided on a continuous basis, subject to interruptions related to technical maintenance or the availability of official sources.

5. Pricing

Displayed prices are stated in Tunisian Dinars (TND) excluding tax (HT). Value-added tax (VAT) at 19% and a fiscal stamp of 1 TND per invoice are added on top; the tax-inclusive (TTC) amount actually charged is shown in the summary before payment. ADSValley reserves the right to modify its prices at any time; subscriptions are billed at the rate in force at the time of purchase confirmation.

6. Subscription / Order

The customer subscribes via the application or the website by following the designated process. Validation of the subscription implies:

• Acceptance of these Terms of Sale;
• Verification of the information provided;
• Confirmation of payment.

ADSValley reserves the right to refuse or cancel any subscription in the event of a prior dispute, suspicion of fraud, non-payment, or incorrect information provided by the customer.

7. Payment Terms

Payment is made online in a secure manner through the Flouci platform (bank card, e-Dinar, wallet / electronic payment). Transactions are secured by our payment partner solutions. ADSValley accepts no liability in the event of a malfunction of external payment platforms.

8. Service Activation

As this is a digital service, no physical delivery takes place. Access to the subscription is activated immediately, or as soon as possible, following payment confirmation.

9. Duration, Renewal and Cancellation

The subscription is taken out for the period chosen at the time of purchase and may be renewed. The customer may cancel the automatic renewal at any time from their account; access to the service remains active until the end of the period already paid for. No pro-rata refund is granted for any period already commenced.

10. Right of Withdrawal and Refund

As the subscription covers a digital content or service delivered immediately upon payment confirmation, the customer expressly acknowledges waiving their right of withdrawal from the moment the service is activated. A refund may only be granted in the event of non-delivery of the service attributable solely to ADSValley (technical failure), upon request sent to contact@case-watch.com within 14 days of the incident.

11. Warranty and Liability

ADSValley undertakes to provide a service consistent with its description. The information displayed is provided for information purposes only and does not constitute legal advice. ADSValley does not guarantee the accuracy or completeness of the public data sourced from official sources. ADSValley's liability cannot be engaged in the event of:

• Misuse of the service by the customer;
• Force majeure;
• Unavailability of official sources.

12. Personal Data Protection

The data collected is strictly necessary for the provision of the service and is processed in accordance with Law No. 63-2004 of 27 July 2004 on the protection of personal data. The customer has the right to access, rectify and delete their data by contacting contact@case-watch.com. For further information, please consult our privacy policy.

13. Intellectual Property

All content on the Case Watch website and application (texts, images, videos, logos, trademarks, design, code) is protected by intellectual property law. Any reproduction, representation, modification, publication or adaptation, in whole or in part, is strictly prohibited without prior written authorisation from ADSValley SARL.

14. Dispute Resolution

In the event of a dispute, the customer is invited to contact customer support at contact@case-watch.com in order to seek an amicable resolution. Failing an amicable resolution, jurisdiction is conferred upon the competent Tunisian courts.

15. Governing Law

These Terms of Sale are governed by Tunisian law. In the event of a dispute, exclusive jurisdiction is conferred upon the competent Tunisian courts.

16. Accessibility of These Terms

These Terms of Sale are accessible at all times on the case-watch.com website. The customer acknowledges having read and accepted them prior to validating and paying for their subscription.
